Legal Observations about Trading in Fake Items

You asked for an attorney's opinion regarding Ski's purchase of the counterfeit note from Ceylon. Well, here goes. 

The purchase and sale of goods is governed by Article 2 of the Uniform Commercial Code (UCC) and principles of contract and tort law. The amount of the transaction and the nature of the parties may also bring state consumer protection laws into play. Violation of consumer protection laws may result in fines or criminal penalties depending on the state. A knowing misrepresentation amounts to fraud which also is a criminal offense. Finally, the Federal Fair Standards in Hobbies Act requires all copies of numismatic material to be identified as such and failure to do so on items created after 1964 can be subject to fines and imprisonment. 

Claiming an item is genuine when it is not amounts to a misrepresentation under the warranty provisions of Article 2 of the UCC and tort laws. It also is a breach of contract. There is a fine line between what is considered sales puffery and misrepresentation, however. Statements as to rarity or opinion as to value generally fall into the latter category and are not actionable. For example, listing common JIM notes on ebay as "rare" with ridiculously high opening bids falls into this category, but the representation of an item as genuine when it is not is a blatant misrepresentation. 

Under the UCC and contract principles, the buyer would have the right to rescind the sales agreement. The object of rescission is to void the contract and return the parties to their relative position prior to the agreement. This would require the buyer to return the goods and the seller to refund the purchase price and any additional charges contemplated by the transaction such as shipping, postage and insurance. 

Under tort law, the buyer would sue for damages for the misrepresentation. The measure of damages is generally the difference between the value of the goods as represented and their true value. A knowing and intentional misrepresentation amounts to fraud and may subject the seller to punitive damages. 

The question of jurisdiction is a complicated one. Generally, a sale is considered to have taken place in the state of residence of the buyer regardless of the location of the seller, unless the choice of jurisdiction is identified in the sales contract or it is a face-to-face transaction. (This is why sales tax is not collected by sellers on interstate mail transactions. It is supposed to be paid by the buyer to the buyer's home state. In Wisconsin, where I live, the Department of Revenue tries to collect the sales tax on out-of-state purchases by Wisconsin residents on the annual income tax forms. It is usually ignored by the taxpayer.) Consequently, the laws of the buyer's state are applicable and the buyer's state would also be the proper venue for litigation. Getting an out-of-state or foreign seller into court and enforcing the judgment may be problematic, however. 

I trust that this answers your questions on these matters. I have to issue my standard lawyerly caveat, however. This discussion is based on general principles of law only and may not be true for a given jurisdiction based on that state's laws.

There will be three major options on the new book. First, the basic book, 400 pages hardbound. Second, the "collectors’ edition," is also hardbound. The cover of this edition says collectors’ edition and has an additional 32 pages for a total of 432. Most of the extra pages are (lined) note pages for, well, taking notes, but there are some additional features in this section, 200 produced. Finally, there is what we are calling the researcher’s edition. This is the same as the collectors’ edition except that it has nice wire binding. This makes it very flexible and ideal for the serious collector. Production on this version was 46 (as in 1946, as in Series 461).

All of the researcher and up to 100 of the collectors’ editions will be numbered and signed. They will also have other little features that have not been finalized.

Everyone wants to know the prices. Even that is not so easy. It is more of a marketing plan. Here it is.

We do not expect to advertise the researcher’s edition anywhere other than the Gram. If any are left, we might take them to shows or just put them in the warehouse.

As stated above, up to 100 of the collectors’ edition will be numbered, autographed and otherwise embellished.

Researchers’ edition--$125

To make it even more complicated, for those who want a "set," we offer the following. Matched numbers of the collectors’ AND researchers’ edition PLUS the matching numbered/autographed basic edition (not sold separately) AND a "work" copy of the basic edition (NOT numbered, autographed, or embellished). Finally, we will prepare these books at the Fest. We will have the collectors’ edition autographed by other major contributors who are in attendance and ship the day after the Fest. The "work" copy of the basic edition will be mailed on the first possible day.

Regarding insurance for the Fest, I can tell you that the Collectibles Insurance Agency's rates are half the rates of the ANA's Insurance carrier. They do offer coverage for "shows and exhibits" as part of their standard policy, but am not sure if they will sell just a two or three day policy if you do not also have a regular policy. I have bought three day coverage from them in the past during a move.

<P>Three airports are reasonably available for the Fest. In order of proximity they are:</P>

<P>All three are reasonable. If you can arrive early enough AND coordinate it well ahead, every attempt will be made to pick you up at the airport to save on rental cars. Festers are encouraged to coordinate among themselves for rides. We will also run notices in the Gram and, finally, we will try to coordinate for Festers to run pickups from Fest central.</P>
